Section 90C Financial Agreement

The Court of Appeal held that a financial agreement providing for both the failure of a de facto relationship and the failure of a subsequent marriage was valid. The main reason for the court`s decision was that there was no necessary conflict between a factual relationship and a subsequent marriage. As has been the case, de facto couples may later intend to marry. There is therefore no reason why couples should fail to reach a single agreement that provides for both the factual and adulterous circumstances.
