In Judaism, the Ketubah, a marriage contract, has long been established as an integral part of Jewish marriage and is signed and read at the wedding. It contains the man`s requirement to support his wife by providing her with food, clothing and sexual intercourse and provides for the wife`s support in the event of divorce or death of her husband. Under this passage, however, a woman can walk if her husband does not take care of her. The bride was no longer communicating with her lawyer before the wedding. On the contrary, a few days before the wedding, she took a short vacation and joined her future husband the day before the wedding. At the time, he gave his fiancÃ©e a taker and told her to have her signed in front of a notary. And that`s exactly what she did on her wedding day at 2 .m. – without reading the agreement! “Pre-marriage contracts are contracts and are generally enforced,” says Andrew Winters, a divorce lawyer with new Hampshire law firm Cohen and Winters. “However, because of their sensitivity, they are under scrutiny to ensure that the agreement was truly voluntary and did not contain unfair or illegal provisions.” Winters says the specific requirements for applicability vary considerably from state to state. But a common requirement is that a lawyer be hired by each party. “It is also reprehensible that the agreement was reached just before the wedding,” he added.
In 2015, the U.S. Supreme Court granted same-sex marriage the same legal basis as same-sex marriage, in the case of Obergefell v. Hodges (decided June 26, 2015). The consequence of the Supreme Court decision is that a pre-marriage contract entered into by a same-sex couple in one state is enforceable in the event of a divorce in another state.  While the carnival of the week is that Justin Bieber and Hailey Baldwin secretly married earlier this week, the even more important news is that they may not have signed a marriage contract. With Justin`s net assets at $265 million and Hailey`s $2 million, it`s a huge wealth imbalance. Depending on the outcome of the marriage, this could result in a big payday for Hailey. Parties may waive disclosure beyond what is expected and there is no certification requirement, but this is good practice.
There are special requirements when the parties sign the agreement without a lawyer, and the parties must have an independent lawyer when they limit spousal assistance (also known as simony or spousal support in other states). Parties must wait seven days after the pre-marital contract has been submitted for review for the first time before signing it, but it does not need to happen a number of days before the marriage.  Prenups often take months to negotiate, so they should not be abandoned until the last minute (as people often do). If the pre-scheme requires a lump sum payment at the time of divorce, it can be assumed that it favours divorce. This concept has been attacked and counsel should be consulted to ensure that Prenup does not violate this provision.
