Sample Child Access Agreement

To determine issues relating to children, such as custody, home visits and assistance, a court must approve any agreement according to the “Best Interests of the Child” standard. If both parents agree on this issue, a court is generally willing to include the agreement in official legal documents. However, there is still the possibility for a court to require an adaptation of the agreement if it finds that the agreement is not in the best interests of the children concerned. The mother has sole and exclusive custody of the children and all final decision-making powers on important issues affecting the well-being of children, including, but not only, issues of education, religion and health care. Notwithstanding the above, the father has the opportunity to participate in decision-making processes on these important issues, except in an emergency. You have to decide where your kids sleep. For example, they could live most of the time with one parent – but visit the other on weekends. The mother and father advise and agree on all important decisions regarding education, illness, operations, medical care, health, well-being and other issues of similar importance concerning children whose well-being, education and development will be the primary concern of the mother and father at all times. It is expressly agreed that the emergency medical needs of each child or child replace the parent`s right to education, unless the other parent is informed immediately or as soon as possible, as is indeed the case with the type of emergency. In this regard, each party may accept the child`s emergency medical treatment and each parent must inform the other of any hospitalization, emergency or otherwise, as soon as the situation is stabilized within 12 hours of the need for such hospitalization. We will support and maintain our children`s relationship with other parents. We will not talk negatively about the other parent.

We will encourage our children to spend time with their other parents and extended family.
